George W. Bush is about to announce John G. Roberts as his Supreme Court appointee.  But just who is John Roberts.  &lt;a href="http://www.independentjudiciary.com/nominees/nominee.cfm?NomineeID=5"&gt;http://www.independentjudiciary.com/nominees/nominee.cfm?NomineeID=5&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;John Roberts is a socially conservative activist judge.  Super.  He believes that public school prayer is okay, and that the Federal Government can regulate abortion...Whatever you do, don't ask him what Article of the Constitution gives the government power to do either one. &lt;br /&gt;&lt;br /&gt;At one point I had a great deal of respect for George Bush, but this is an incredible betrayal of my trust.  I don't care is a Constitutionalist would be called extreme, George.  You said you'd appoint one and you didn't...in English, we call that a lie. Someone who upholds the Constitution 50% of the time? How 'bout appointing a man or woman who faithfully upholds the Constitution...you know, like that oath says? Oh, that's right, because a Constitutionalist will be labled an "ultra-conservative" by the Democratic Party. That's right boys and girls, doing your job as a member of the judiciary will result in your record being called into question and your character being impuned, welcome to America 2005. So what will wind up happening is instead of appointing a hardcore Constitutionalist [cough, Janet Brown], a wishy washy, I love everybody judge will be appointed, maintaining the number of judges who couldn't care any less about the Constitution at seven. If you are a Democrat or anyone really who thinks that Constitutionalism is extreme, I'm asking you why? Seriously. Why is it that a judge that upholds the Constitution at all costs extreme? In addition, he re-explained why he will not commit more troops to Iraq saying, "If my generals tell me they need more troops, I'll give them to them."  That's easy to say after firing the generals who speak out now isn't it.&lt;br /&gt;&lt;br /&gt;What pissed me off the most was this though, and I'm paraphrasing, "The terrorists in Iraq are of the same mentality of those that attacked us on 9/11."  Yeah, I know, that &lt;em&gt;is&lt;/em&gt; true, but that wasn't what he was trying to do. You don't have to go to Yale Law to realize that that means just what it says, no gov't seizure of private land without just compensation, so long as the seized land is used as public property.&lt;br /&gt;&lt;br /&gt;Well, the Supreme Court of these United States has decided that that particular clause is meaningless. They decided today 5-4 that local towns can seize PRIVATE land in order to make way for PRIVATE development. Call eight of your friends over to you house, ask them to read that last sentence. If they and you can't see the word public in it, tell them to raise there hands. Okay, good, nine hands up right? No, no, don't panic, you're not wrong, it's just that mind-numbingly easy. The Supreme Court has failed us again. Meanwhile: The PATRIOT ACT's renewal is being pushed by conservatives, the Senate is wasting it's time appologizing for anti-anti-lynching law past acts, the President's approval rating is approaching Stalin's and oh, by the way, we're still at war.  Jesus, we've got our priorities straight.&lt;br /&gt;&lt;br /&gt;Part II:  Anyone watching the Discovery Channel's 100 Greatest Americans?  How unthinkably depressing.  If you haven't, the concept is, our fellow countrymen [countrypeople?] vote on who they think are the greatest Americans.  I checked out the website, looked down the list which is ordered alphabetically...Hmmm, let's see here...Martin Luther King Jr., Malcom X, Marylin Monroe...Wait what?  Oh yeah, down the line some more was Jacko, and that was before he was aquitted.  We the people were willing to put a whore and a possible child molester on the list of greatest Americans along with the likes of George Washington and Benjamin Franklin. In an act that even a ninth grader would call "gay, dude", the Republicans immaturely cut the mics of dissenting Democrats who attempted to recommence the debate. Wow...Predicably enough, Fox News didn't mention this little indisgression on any of their shows last night...See no evil, hear no evil, say no evil right?&lt;br /&gt;&lt;br /&gt;What pissed me off the most about this is the fact that the man who the Repubs shut up as they walked out just happened to be some guy who was elected by those dudes in that City in New York with the towers, you know what I'm talking about. He was the Congressmen from Lower Manhattan. Well gee whiz, I sure as hell would like to know his opinion on the PATRIOT ACT. But apparently the Repubs already knew, and well, they're just not going to put up with this "dissention" BS. If I were a Republican official sitting on a contested Congressional seat, I'd be worried come 2006. Unfortunately, Pro-Liberty Candidate and former Jersey City Mayor Brett Schundler was defeated by a still fairly pro-liberty former mayor of West Windsor, Doug Forrester. Though I am unhappy with Schundler's defeat, as a former West Windsor resident, I can say with 100% certainty that Doug Forrester is a far safer choice than Senator Corzine to run the Great State of New Jersey. Accordingly, I hereby endorse Former Mayor Forrester as the next Governor of New Jersey. We've had legitimate state's rights in this country for over 200 years, but ever since the Civil War, they've been eroded, little by little.  The most recent example is this week's ruling by the Supreme Court against the usage of medicinal marijuana.  By a 6-3 decision, the Supreme Court ruled against Diane Monson, a Californian who uses marijuana to ease pain caused by her numerous health issues, stating that allowing medicinal marijuana violates federal drug laws [which are inherenetly unConstitutional, but hey, they're the gov't, they can do anything].  What's really annoyed me about this whole thing are the "champions of civil rights", the liberals, and how they're handling this.  They aren't angry, they're whiny.  On the Alan Colmes radio show on Sirius Radio last night, a liberal whose name was not important enough for me to remember was saying that, well, as long as the women were using is medicinally, I don't see what the problem is...Actually, if these women were lighting up for the hell of it that'd be perfectly fine by me.  Why is it extreme to support legalizing pot?  Ask yourselves that.  Don't just say wow, CP's nuts, he wants to legalize all drugs...Think about it!  Why not?  And if that doesn't work, ask yourself, is the drug war a right given to the government in the Constitution.  When you arrive at the inevitable "no" answer, then ask yourself why you support it. They said in their statement that the death was a result of  &lt;blockquote&gt;"...tension....inexperience and stress led some of the U.S. troops to react&lt;br /&gt;instinctively and with little control."&lt;/blockquote&gt;  Well...that's a relief, I thought that we might have a problem on our hands.  Troops guarding a "shoddy, and ill protected" checkpoint were trying to kill an allied officer, they were just inexperienced, tense and uncontrolable...phew. The judges cite that according to Oregon state law, that gays have no legal entitlement to marriage...Do I disagree with the FACT that they don't have that right...Sure...Is the Court right in it's decision...Absolutely.  If the Court did not nullify the marriages, they would be legalizing gay marriage in Oregon, which, I believe, would be the job of the Legislature.  The decision is a right one, technically Oregon's laws do not give gays the right to marriage, don't like it? Great idea, maybe we should have a government police-type force PATROL the BOARDER. That's a damn good idea...Anyway....In theory I do believe that these citizens should be able to enforce the law that our government refuses to enforce, however, I can definitely foresee some abuse arising from untrained vigilantes patrolling our boarder. While I do think that these Minutemen have their hearts in the right place, they aren't qualified [like our boarder patrol&lt;--Sarcasm/Cynicism] and they create an atomosphere that fosters the possibility of abuse. Good idea...in principle, not practice. For those of you who are unaware, this man [and US CITIZEN no less]...amazingly has been held in dentention by the United States Government for almost three years...Without being charged with a crime! Our government in one of the most amazing uses of doublespeak in the history of organized thought, has told us that his detainment is completely legitimate because they're sure he was GOING TO commit a crime. Two things...um...by detaining him without charging him...YOU ARE TOO! Second, if it was/is sooooo obvious that he was going to commit a crime, then why the hell haven't you charged him with anything!? Incredible...Oh, and our judges...you know, the guys with the funny wigs and the hammers...yeah, them...the ones charged with the job of upholding our Constitution, they've already ruled that his detainment is illegal. From the article &lt;blockquote&gt;"In February, a federal judge ordered Padilla's release within 45 days, arguing&lt;br /&gt;the government had no right to suspend due process of law. There was no way in Hell the Supreme Court could go 3 straight rulings without screwing up.  The Supreme Court has decided that they will not hear a case regarding the unconstitutionality of police dogs being used without a warrant.&lt;br /&gt;&lt;br /&gt;The Supreme Court's reasoning was that the dogs were not violating the 4th Amendment which protects [or should I say protected] against unreasonable searches.  Pardon my French but what the bonjour are the dogs there for?  They're there to SEARCH!  Without a warrant, probable cause or even a suspicion.  If that isn't a violation of our rights than what is. This is amazing, two Supreme Court rulings, two Supreme Court rulings approved by me. This is the right decision. Outside references have no place in the courtroom, including the Bible. Individual cases need to be looked at, examined and then though out, not referenced. I believe the Bible has a line that okays the flogging of adulterers [or possibly thieves, but you get my point], so how far do you draw the line. This begs the obvious question of, "How can you tell if it someone's discriminating against you if they don't even know it?" Let that sit for a while. Again, I'm up in the air about this one. Let's look at it from a Constitutionalist's point of view.&lt;br /&gt;&lt;br /&gt;Section One of the Fourteenth Amendment to the Constitution doth state that the State cannot, "deny to any person within it's jurisdiction equal protection under the law." If you look at it this way, the law is absolutely correct. If other workers can sue if they feel that they are being discriminated against, then the "older workers" [40 isn't old] should have the right to do so as well.&lt;br /&gt;&lt;br /&gt;But now let's look at it from a libertarian's point of view...&lt;br /&gt;&lt;br /&gt;An employer has the inherent right to hire and fire anyone he/she wants for any reason, it's his/her business, he/she makes the decisions, he/she accepts the consequences of those decisions. People are dying...and outside, members of the media, including Sean Hannity and Alan Colmes are covering the final hours of a dying woman.  Jesus Christ.  Let the woman die in peace...Let the family mourn their loss in peace.  This is none of your damn business.  Absolutely incredible.  I'm at a loss for words. &lt;br /&gt;&lt;br /&gt;The "Christian Right", God-fearing, moral people are hold up outside of a hospice trying to involve themselves in a family issue...Is that what Jesus would do? A large family arguement, but a family arguement nonetheless.  What possible authority do &lt;em&gt;they&lt;/em&gt; have to decide a woman's fate.  Any more than her husband?  I don't think so.  The goverment's saying "Oh, that man has no right to make decisions regarding this womans faith...but we sure as hell can!"  Let the legal guardian decide and move on, stop making this woman's final days a circus.&lt;br /&gt;&lt;br /&gt;Almost Non-Existant Socially Conservative Me: Jesus, how is her husband even this woman's guardian?  Seems to me as though he's moved on, a completely uninvolved person in this woman's life [who by the way, didn't have the stones to watch her feeding tube pulled out] is making a decision to end her life?  How aren't the parents' voices considered?&lt;br /&gt;&lt;br /&gt;Given my schizophranic stance on this issue, my fall back is the law. Oy vey. I'm a big Washington Post supporter, but give me a break. Oh, I should probably explain what I'm complaining about, huh? You've probably heard that Walter Kronkite, and several others that were close to Dan Rather at CBS have recently blasted him publically. Rather said that he wouldn't respond to these people...That's what the author of the linked article meant by the high road? [rolls eyes, then inhales]You know what, let's just forget about Dan Rather's 40+ year career of partisan journalism, which, as we all know, was capped off by one of the most embarassing journalistic moments since Dewey beats Truman and skip right to the part where Rather has the morals not to respond to people who publically mentioned how horrendous of a job he's been doing [exhales]. Dan Rather is commendable for not responding to people who correctly pointed out that his career, specifically the past few years have been a joke. What a guy. I wonder, if Rather &lt;em&gt;was&lt;/em&gt; going to say something&lt;em&gt;,&lt;/em&gt; how would he respond? Both side are driving me nuts:&lt;br /&gt;&lt;br /&gt;The Right: Christianity is part of American history and culture.  We need to be reminded of what we stand for.&lt;br /&gt;&lt;br /&gt;George Washington :  The Constitution is in no way based on the Christian religion.&lt;br /&gt;&lt;br /&gt;Me: Yeah, what George said.  In addition, you mean to tell me that a judge needs a &lt;em&gt;reminder&lt;/em&gt; when ruling on cases.  And that reminder has to come from the Bible?  Sorry, not buying it.&lt;br /&gt;&lt;br /&gt;The Left: This is an outrage!  You Christians are breaking the First Amendment, keep your damn morality to yourselves.&lt;br /&gt;&lt;br /&gt;Me: The Constitution says that government can't establish religion.  Found-To set up; also, To cause to be recognized and accepted.  By placing the 10 Commandments in a government building the gov't is attempting to recognize Christianity, however, it clearly is &lt;strong&gt;not&lt;/strong&gt; being accepted.  So would I prefer the 10 Commandments be taken out of gov't bulidings, yes. One more time...A beauty pageant in Africa is entitled Miss HIV Stigma Free.  I'm speechless [a condition that I'll fight through]. From the article,&lt;br /&gt;&lt;blockquote&gt;Prosecutors were considering Tuesday whether to file charges against a&lt;br /&gt;79-year-old woman who police say injured two officers when she struck them with&lt;br /&gt;a wooden cane. The officers, both of whom were treated for their&lt;br /&gt;injuries at area hospitals, were hurt after they arrived at the woman's home to&lt;br /&gt;check on her welfare. One officer had a separated shoulder and hand injury while&lt;br /&gt;the other might have suffered a mild concussion, said Jaimee Thirion, a&lt;br /&gt;spokeswoman for St. Joseph County police.&lt;/blockquote&gt;A police officer, trained to take down dangerous criminals was smacked around by an 80 year old with a walking cane. Wait, it get's better, here's what the county's esteemed prosecutor had to say...St. Joseph County Prosecutor Michael Dvorak said officers were called to the home to investigate a possible domestic abuse charge against the caretaker.&lt;br /&gt;&lt;br /&gt;&lt;blockquote&gt;"This is a serious concern because police are there to protect all of us,"&lt;br /&gt;Dvorak said. &lt;/blockquote&gt;Protect us? Mr. Dvorak, you're officers couldn't protect &lt;em&gt;themselves &lt;/em&gt;from a &lt;em&gt;79 year old women; &lt;/em&gt;let's not get ahead of ourselves. By far the biggest gem of an excuse came from another lawyer on TV, explaining what happened, and why it was so dastardly.&lt;br /&gt;&lt;blockquote&gt;"The defendant snuck up on the officers and assaulted them with a deadly&lt;br /&gt;weapon." &lt;/blockquote&gt;I can't help but smile when someone brings up the possibility of &lt;em&gt;a 79 year old "&lt;/em&gt;sneaking". I passed through Bill O'Reilly's, don't' worry, it's for entertainment value only. Apparently he still has his nickers in a twist about Ward Churchill. While listening to his and Michael Savage's radio show [again, entertaining], I've been startled by many callers who have stated with absolute certainty that Americans have no right to say something that "is damaging to the country". Oy vey. I'm no Ward Churchill fan, but gee whiz. Was he an absolute moron for calling Sept. 11th victims little Eichmanns? Absolutely. Is he well within his rights in doing so, absolutely. Furthermore, since he works for a public university [and therefore, the government], firing him would be overtly unconstitutional. So go ahead, hate Ward Churchill, that's justifiable, he's a horrible person. The interceptor rocket who's job it is to blow enemy missiles out of the sky, did not, itself, get into the air. Experts were surprised by the system's failure, and with good reason, given its success in the past. I wonder how much money that thing costs to test, needless to say create. Not that we need any of that money though. I mean, the roads in this country are in perfect shape, the state of our education couldn't be better, our boarder with Mexico doesn't resemble a cheese grater and we're certainly not facing down the largest budgit deficit ever [thank God]. So now that our country is completely devoid of problems, we can afford to appease our inner Star Trek fan with missile defense and the like. No, not the PATRIOT ACT, and its illegality; no, not Affirmative Action and its illegality. The Supreme Court of the United States of America has tea in its crosshairs. Apparently a church in New Mexico is using a halllucinogenic tea in its services that our government has deemed "potentially dangerous" [you know, like cars, knives, cell phones, football, runnning...]. And to think that I've said that the Supreme Court is failing miserably at its task of upholding the Constitution! Anyway, even our newly appointed Attorney General has gotten in on the act. Alberto Gonzales has stated that a lower court's decision that allowed this church to import this tea from Brazil into the United States was "wrong". The answer is apparently, no.  It seems as though Democrats believe that their message was not conveyed to Americans clearly enough.  Senator John Kerry [remember him?] has stated that "the Democratic Party doesn't need a makeover."  Okay, Democrats, John Kerry is giving you advise on how to win a Presidential eleciton.  I'll repeat that, &lt;em&gt;John Kerry&lt;/em&gt; is giving you advice on how to win an election.
